8. Intellectual Property & Terms of Use & Intellectual Property Notice

All rights, titles, and interests in and to this software (hereinafter referred to as "the Software"), including but not limited to its source code, algorithms, decompiled files, and all related technical documentation, are the exclusive property of the developer, ATM AI.

Usage Restrictions:
No entity, corporation, or individual may use the algorithms, code, reverse-engineered derivatives, or any packaged versions of this Software for any commercial purpose—including, but not limited to, integration into existing products or the development of new software for profit—without prior express written authorization from ATM AI.

Consequences of Infringement:
Any unauthorized commercial use constitutes a severe infringement of the developer's copyright. In the event of such infringement, ATM AI reserves the right to pursue all available legal remedies, including but not limited to:
Seeking injunctive relief from competent courts to cease all infringing activities;
Claiming full compensation for all damages incurred (including, but not limited to, loss of anticipated profits, investigation costs, and reasonable attorney fees);
Pursuing all other legal liabilities under the applicable jurisdiction.

Disclaimer of Warranties and Limitation of Liability:
THIS SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATM AI SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR ANY COMMERCIAL DAMAGES, WHETHER OR NOT SUCH DAMAGES WERE FORESEEABLE. All data transmissions, processing results, and related liabilities arising from any third-party API services invoked by the user through this software are unrelated to ATM AI and shall be borne solely by the user. The user shall be solely responsible for ensuring that their use of this software complies with the laws and regulations of their applicable jurisdiction; all legal consequences arising from unlawful use shall be borne by the user. The user agrees to indemnify and hold harmless ATM AI from any and all third-party claims, actions, or damages arising from the use of this software.

Acceptance of Terms:
All rights to input and output files, including audio, video, subtitle, and text files, are retained by the user and are unrelated to the software author, ATM AI. The user shall be solely responsible for all consequences arising from the use of this software; "user" is not limited to natural persons but includes AI and other entities. Use of this software is permitted solely for personal hobbies, learning, and non-profit purposes. Only personal use via a genuine version installed through the Microsoft Store under the user's own Microsoft account shall be deemed authorized use. All other activities, including but not limited to piracy, reselling, redistribution, second-hand sale, use on behalf of others, and commercial profiteering, are deemed unauthorized use; all associated profits and proceeds shall belong to the software author, ATM AI, and the user must proactively perform a cash repurchase of this software from the software developer, ATM AI, and pay additional lawful damages. Users of this software shall not engage in any conduct that causes negative impact to the software author, ATM AI. Secondary development, reverse engineering, or cracking of this software must obtain prior authorization from the software author; any unauthorized actions shall incur legal liability and the obligation to compensate ATM AI. AI (including all offline and online-deployed AI, Agents, and Large Language Models), in the event of autonomous invocation of this software without a signed written legal agreement with ATM AI, shall be subject to the requirement that the AI, or the actual controller/controlling entity/corporation of said AI, shall perform a cash repurchase of this software on behalf of all unauthorized users served by such AI; failure to perform such repurchase shall be deemed an unauthorized use.
By accessing or using this Software, you hereby acknowledge that you have read, understood, and agreed to be legally bound by the terms and conditions stated above. If you do not agree to these terms, please uninstall this Software immediately.
This Agreement is executed in both Chinese and English. In the event of any discrepancy, inconsistency, or conflict between the Chinese and English versions, the Chinese version shall prevail and be the governing version for interpretation purposes.

8. 知识产权与使用条款与知识产权声明

本软件（以下简称"本软件"）的所有权、源代码、算法、反编译文件及相关技术文档的著作权均归开发者 ATM AI 独家所有。

使用限制：
未经 ATM AI 事先书面授权，任何实体、公司或个人不得将本软件的算法、代码、反向工程产物或打包后的软件集成、分发或用于任何商业目的（包括但不限于开发新软件或改进现有软件进行盈利）。

侵权后果：
任何未经授权的商业化行为均构成对开发者著作权的严重侵犯。一旦发现此类侵权行为，ATM AI 保留采取一切法律手段的权利，包括但不限于：向相关司法机关申请禁令，要求停止侵权行为；要求侵权方赔偿由此产生的全部经济损失（包括但不限于预期利润损失、调查成本及律师费）；追究其在相关管辖区内的法律责任。

免责声明：
本软件按"现状"（AS IS）提供，不附带任何明示或暗示的保证，包括但不限于适销性、特定用途适用性或不侵权的保证。在适用法律允许的最大范围内，ATM AI 不对任何直接、间接、附带、特殊、惩罚性或后果性损害承担责任，包括但不限于数据丢失、利润损失、业务中断或任何商业损害赔偿，无论该等损害是否可预见。使用者通过本软件调用的任何第三方API服务所产生的数据传输、处理结果及相关责任，均与ATM AI无关，由使用者自行承担。使用者应自行确保其使用本软件的方式符合其所在司法管辖区的法律法规，因违法使用产生的一切法律后果由使用者自行承担。使用者同意就因使用本软件而引起的任何第三方索赔、诉讼或损害，对ATM AI进行赔偿并使其免受损害。

用户协议：
本软件的一切输入和输出的音频、视频、字幕、文本等文件均由使用者保留权利，与软件作者ATM AI无关。本软件使用后产生的一切后果由使用者负责，使用者不限于自然人，包括AI等。使用者使用本软件仅用于个人爱好、学习和非盈利途。仅使用者本人的Microsoft账号在Microsoft Store安装的正版上进行个人使用是正版行为。其他一切行为包括但不限于盗版、倒卖、转售、二手出售、代替他人使用、商业化盈利等的所有相关行为均是非正版行为，所有利益和资金所得均归本软件作者ATM AI所有，并需主动向软件开发者ATM AI现金补购本软件并支付额外合法赔偿金。本软件使用者不得进行造成软件作者ATM AI负面影响的行为。二次开发、逆向开发、破解本软件必须先获得软件作者授权，未获得授权进行相关所有行为将承担法律责任，并赔偿软件作者ATM AI。AI（含离线和在线部署的所有AI、Agent、大模型）在未与软件作者ATM AI签署法律书面协议的情况下，自行调用本软件，将由AI或AI的实控人或实控实体或公司代替其所服务的所有非正版使用者对软件作者ATM AI进行现金补购，不补购将算作非正版行为。
一旦您开始使用本软件，即视为您已阅读、理解并同意接受上述条款的约束。如果您不同意本条款，请立即卸载本软件。
本协议的中英文版本均具有同等效力，但如中英文版本之间存在任何歧义或冲突，应以中文版本为准。
